This website, avelinemoreau.com (the "Site"), is the exclusive digital Flagship of the Maison Aveline Moreau ("Aveline Moreau," "we," "us," "our"). These Terms of Service (the "Terms") constitute a binding legal charter governing your access to and use of the Site, and all purchases of our creations ("Products").
By accessing this Site or effectuating a purchase, you affirm your unconditional agreement to be governed by these Terms in their entirety. We reserve the right to amend these Terms at our sole discretion; the date of the most recent revision will be noted above. Your continued patronage of the Site following any amendment constitutes your binding acceptance of the revised Terms.
ARTICLE I: INTELLECTUAL PROPERTY & LIMITED LICENSE
All content present on this Site, including but not limited to text, graphics, logos, images, product designs, and the overall "look and feel" (collectively, the "Content"), is the exclusive and inalienable property of Aveline Moreau. This Content is protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.
You are granted a limited, revocable, non-transferable license to access and use the Site for your personal, non-commercial use only. This license expressly prohibits: the modification, distribution, transmission, or reproduction of any Content; the use of data mining, robots, or similar data gathering and extraction tools; and the creation of a hyperlink to the Site without our prior written consent. Any unauthorized use terminates the license granted herein and will be pursued to the fullest extent of the law.
ARTICLE II: THE PURCHASE OF CREATIONS
Product Descriptions: We endeavor to present our creations with the utmost accuracy. However, we do not warrant that product descriptions, colors, or other content on the Site are infallible. The essence of our creations lies in their artisanal nature, and slight variations are a mark of this authenticity.
Pricing & Payment: All prices are stated in U.S. Dollars. Prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed. You agree to provide current, complete, and accurate purchase and account information for all purchases. You authorize us to charge your chosen payment provider for any such purchases, including all applicable taxes and shipping charges.
Order Acceptance: Your placement of an order constitutes an offer to purchase. We reserve the unequivocal right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing, or suspicion of fraudulent activity. An order is not accepted, and a contract of sale is not formed, until the moment we dispatch the Product and send you a formal Shipment Confirmation.
Title and Risk of Loss: Title to and the risk of loss for all Products pass to you upon our delivery of the items to the designated shipping carrier.
ARTICLE III: USER CONDUCT & OBLIGATIONS
In using this Site, you agree not to engage in any activity that would compromise the integrity, security, or commercial purpose of Aveline Moreau. This includes, without limitation: (a) attempting to interfere with the proper working of the Site; (b) circumventing any measures we may use to prevent or restrict access; (c) engaging in any automated use of the system, such as using scripts to send comments or messages; or (d) using the Site for any illegal or unauthorized purpose.

THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AVELINE MOREAU MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, OR PRODUCTS INCLUDED THEREIN.
TO THE FULLEST EXTENT PERMISSIBLE BY LAW, AVELINE MOREAU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
AVELINE MOREAU WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE OR FROM ANY PRODUCTS PURCHASED FROM THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM.
ARTICLE V: INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Aveline Moreau and its directors, officers, employees, and agents from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your breach of these Terms or your use of the Site.
ARTICLE VI: GOVERNING LAW & DISPUTE RESOLUTION
These Terms and any dispute arising therefrom shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
Any controversy or claim arising out of or relating to these Terms shall be settled by final and binding arbitration administered by the American Arbitration Association (AAA) in Sheridan, Wyoming. YOU UNDERSTAND AND AGREE THAT BY ENTERING INTO THESE TERMS, YOU ARE WAIVING THE RIGHT TO A TRIAL BY JURY. FURTHERMORE, ANY ARBITRATION SHALL BE CONDUCTED IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE PROCEEDING.
ARTICLE VII: GENERAL PROVISIONS
Entire Agreement: These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and Aveline Moreau.
Severability: If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
